BACKGROUND:

Submerged lands (canal waterways) are owned by the State of Florida.  As such any improvements or infrastructure located in or crossing through state submerged lands requires the execution of a submerged land easement.  The previous easement for the Caxambas Court bridge has expired.  This easement document must be signed by the chairman of the City Council of Marco Island and the State of Florida Bureau of Public Land Administration Chief as agent on behalf of the State of Florida Board of Trustees of the Internal Improvement Trust Fund.  The effective period of the easement is September 5, 2022 through September 5, 2072.

FUNDING SOURCE / FISCAL IMPACT:  N / A

RECOMMENDATION: 

Authorize the Chairman of the City Council of the City of Marco Island to execute the submerged land renewal easement No. 40030 (5199-11) with the State of Florida Board of Trustees of the Internal Improvement Trust Fund allowing the Caxambas Court bridge improvements within the State of Florida sovereign submerged lands for a period of 50 years.

POTENTIAL MOTION: 

“I hereby move to authorize the Chairman of the City Council of the City of Marco Island to execute the submerged land renewal easement No. 40030 (5199-11) with the State of Florida Board of Trustees of the Internal Improvement Trust Fund allowing the Caxambas Court bridge improvements within the State of Florida sovereign submerged lands for a period of 50 years.”
