DISCUSSION - Proposed changed to the City of Marco Island Code of Ordinances Chapter 38 - Planning, creating an application methodology and general review requirements for amendments to the Comprehensive Plan.

Body                     

BACKGROUND: 

Staff initated change amending Chapter 38 of the Code of Ordiances. This change was iniated due to the need for a review methodolgy (processing, noticing, and hearing with associated fees) for amendments to the City’s Comprehensive Plan. Florida State Statutes allow for a comprehesive plan amendment (ss.163.3184) which also includes a section allowing for a Small Scale Amendment (land area 10 acres or less). Unfortunaely, the City has no procedure for application and review.

Staff has had inquires regarding the process under State requirments and believes this process must be codified in our laws for consistenty.

RECOMMENDATION: 

Discuss changes.

POTENTIAL MOTION:  

Approve moving forward with changes. Ordinance change requires advertised public hearing which staff will bring back to Planning Board with recommendation going to City Council.
