PROJECT DESCRIPTION:

The total length of the seawall is approximately 137.94 feet requiring a fifteen (15) foot setback from the property line. The request is to have a seven and one-half (7.5) foot setback along the southeast portion of the seawall. The application, response to the criteria used to review a variance and plans are attached.


FUNDING SOURCE / FISCAL IMPACT: Applicant has paid $1,500.00 in applicable fees.

PUBLIC NOTICE REQUIREMENTS: 15 days prior to the Planning Board hearing.

RECOMMENDATION:

STAFF RECOMMENDATION AND FINDINGS:

Staff recommend the Planning Board deny the Owners' requested riparian encroachment based on the below findings:

1. There are no special conditions related to the subject property or waterway. This end of the canal lot with two frontages is not uncommon.
2. The boat docking facility adequately provides reasonable access, with or without a variance.
3. It is difficult to say if granting the variance will impact the surrounding property owner's view. The property owner provided a letter of no objection from the adjacent neighbor and this is at the end of canal.
4. It is difficult to say if the encroachment will infringe upon the use of neighboring properties since Staff are not boat captains and docks can and are rebuilt over time. The proposed dock location (area of requested encroachment) appears that personal water craft will need to use a bit of the area in front of the neighbor to maneuver into the space/lifts.
