BACKGROUND: On January 20, 2009, the City of Marco Island and Collier County entered into an Interlocal Agreement for Debris Removal. Under the agreement, Collier County coordinates and administers post-disaster debris collection, management, and disposal operations, including debris removal activities within the City of Marco Island. The agreement also establishes responsibilities related to reimbursement of debris removal costs that may be deemed ineligible for state or federal reimbursement.
On June 26, 2025, Senate Bill 180 (Chapter 2025-190, Laws of Florida) became effective and amended Section 403.7071, Florida Statutes, relating to the management of storm-generated debris. The legislation now requires each county and municipality to apply to the Florida Department of Environmental Protection (FDEP) for authorization of at least one Disaster Debris Management Site (DDMS) and to annually seek preauthorization of previously approved sites. Alternatively, municipalities may jointly apply for authorization of a DDMS with a county or adjacent municipality through an approved memorandum of understanding or interlocal agreement.
Collier County subsequently coordinated with FDEP regarding implementation of the new statutory requirements. FDEP advised that the County is not required to submit a new authorization request this year and instead must provide a fully executed interlocal agreement together with the finalized list of jointly utilized debris management sites.
