BACKGROUND

 

Multiple lawsuits have been filed challenging the constitutionality of Florida’s Senate Bill (SB) 180 (2025). The legislation limits local government authority over land-use and growth management decisions.


The legal challenge, led by several cities and counties (25 have joined, as of September 30, 2025)  along with “1000 Friends of Florida”, a non-profit advocacy organization, seek to have the law declared unconstitutional and its enforcement blocked. The plaintiffs argue that SB 180 violates the Florida Constitution by preempting local government powers to manage development, guide growth, and protect environmental resources.

 

Vice-Chairman Stephen Gray is providing a white paper addressing the merits of the City of Marco island joining other municipalities and counties with a lawsuit challenging the legalities of SB 180.

 

Included is an example Resolution from the City of Naples declaring SB 180 unconstitutional and participation with a lawsuit to prohibit SB 180.
