BACKGROUND:

The City received their first Live Local Project submittal for a 27-unit mixed use project at 2330 San Marco Road.  Staff completed the review of the Project, and approved the Project pursuant to Section 166.04151(7), Florida Statutes.  Pursuant to the Live Local Act, forty percent (40% )of the units (11) must remain affordable for a thirty (30) year period.  To ensure the units remain affordable for thirty years, the LURA, attachment 1, needs to be approved by the City Council, and then recorded in Collier County Public Records by the applicant.  Staff and legal have reviewed the attached LURA, and are recommending the City Council approve the agreement in conformance with the Live Local Act requirements.

In addition to the LURA, the civil site plan, architectural plan, and elevations have been attached to this memorandum.

FUNDING SOURCE / FISCAL IMPACT:  Applicant has paid $6,286.00 in applicable fees.
