Please refer to the correspondence from Zachary W. Lombardo, the agent representing SDP-24-000139, consisting of the Site Development Plan Amendment for Rose Marina, which was conditionally approved at your April 3rd Planning Board meeting.

 

It has come to my attention that the Marco Island Princess, a dining/sightseeing cruise ship (www.themarcoislandprincess.com) referenced in the parking study (attached), is advertising a capacity of 149 seats, when their currently approved Commercial Zoning Certificate and their conditionally approved SDPA, before you, are for 75 seats.

 

From the staff's perspective, uses and seat configurations can change as long as they meet the parking capacity on the approved site development plan, and the corresponding uses/parking requirements per Sec. 30-488. Compliance is reviewed per Sec. 30-66 (f) - Building permit and certificate of occupancy compliance process. Any increase in intensity above what had been approved would be considered a code violation and would be handled accordingly.
