BACKGROUND: 

 

Councilor Honig recently attended a Florida League of Cities seminar on Medical Marijuana. At the May 6, 2019 meeting, Councilor Honig presented his observations for Council discussion.

 

Following discussion, Councilor Young requested this item be brought back before Council for additional deliberations. 

 

Councilor Grifoni has submitted the attached additional materials. Also attached are sample ordinances, one of which prohibits Medical Marijuana Dispensaries and one which allows Dispensaries.  As the City Attorney has pointed out, the City’s Land Development Code currently does not explicitly prohibit Dispensaries, but it effectively prohibits them because it does not explicitly allow them.

 

 

 

FUNDING SOURCE / FISCAL IMPACT:  N / A

 

 

RECOMMENDATION:  City Staff is requesting direction from Council.  There are three options: (1) Continue the status quo, (2) Request the Planning Board to consider an ordinance permitting Medical Marijuana Dispensaries, or (3) Request the Planning Board to consider an ordinance explicitly prohibiting such Dispensaries.
