DESCRIPTION:

Discussion item per direction from the City Council, Amending Section 30-482 - General Applicability, of the Land Development Code (LDC) regarding off-street parking, to only require additional parking to existing buildings for changes in use and/or intensity for eating establishments, drinking establishments, barbershops, salons, and similar personal care establishments where chairs determine parking requirements.

Property owners and agents attended the January 19th City Council meeting and asked that the parking requirements be relaxed for existing commercial buildings. If the Planning Board wishes to move forward with changes, the amended Ordinance will be advertised and brought before the Planning Board at the March meeting for a recommendation of approval to the City Council.

Staff has provided possible amendments below, eliminating the need for additional parking requirements in a change or enlargement of use except for "eating establishments, drinking establishments, barbershops, salons, or similar personal care establishments where chairs determine parking requirements."
Sec. 30-482. General applicability.
Wherever in any zoning district off-street parking facilities are provided for the parking or display of any and all types of vehicles, boats or heavy construction equipment, whether such vehicles, boats or equipment are self-propelled or not, and all land upon which vehicles traverse the property as a function of the primary use (including "drive-in" facilities) hereinafter referred to as "other vehicular uses," such facilities and land shall conform to the minimum requirements of this article.
