BACKGROUND:

PROJECT DESCRIPTION:

Bayshore Marine Consulting, LLC. has submitted, on behalf of Rachel C. Mishka Trust (the “Owner”), a petition for approval to reconstruct an existing boat house at the above-referenced property. The proposal is to allow for the reconstruction of a pre-incorporation boat house which was not issued a building permit pursuant to Sec. 54-116(b)(3). The petition, plans, and narrative are attached.

FUNDING SOURCE / FISCAL IMPACT: Applicant has paid $1,500.00 in applicable fees.

PUBLIC NOTICE REQUIREMENTS: 15 days prior to Planning Board meeting

NOTICE APPEARANCE DATE(S): October 19, 2026

RECOMMENDATION:

STAFF RECOMMENDATION AND FINDINGS:

The existing boathouse pre-dates City incorporation and has been shown on Property Appraiser assessment records for 40 years. The proposed boathouse reconstruction meets four out of the five criteria listed in Section 54-116(b)(4). The requirement to protrude a maximum of 23 feet (20 feet plus three feet for a roof overhang) is exceeded by 2.6 feet. Staff feel the visual impact of the additional protrusion is lessened by the wide waterway width and substantial side riparian setbacks. The proposed boathouse reconstruction wouldn’t have any more of a visual impact than a boat canopy - which is permitted by code - and would be allowed up to a 30-foot protrusion. Staff recommend the Planning Board forward a recommendation for approval to the City Council.

Findings:

1.                     The reconstructed boathouse will have side riparian setbacks of 54 feet and 64 feet, respectively.

2.                     The existing boathouse protrudes 25.6’ into the Briarwood Waterway. The waterway is approximately 193 feet wide as measured perpendicularly from the subject boathouse.

3.                     The existing boathouse measures 15 feet above the dock decking; the rebuilt boathouse will have the same dimensions.

4.                     The boathouse reconstruction plan states that the roofing material, color, and dimensions will comply with the required criteria. The existing boathouse flat-style roof is the same material and color as the principal structure.

5.                     No human habitation or storage of materials will occur within the boathouse.
