BACKGROUND:  On January 20, 2009, the City of Marco Island and Collier County entered into an Interlocal Agreement for Debris Removal. Under the agreement, Collier County coordinates and administers post-disaster debris collection, management, and disposal operations, including debris removal activities within the City of Marco Island. The agreement also establishes responsibilities related to reimbursement of debris removal costs that may be deemed ineligible for state or federal reimbursement.

On June 26, 2025, Senate Bill 180 (Chapter 2025-190, Laws of Florida) became effective and amended Section 403.7071, Florida Statutes, relating to the management of storm-generated debris. The legislation now requires each county and municipality to apply to the Florida Department of Environmental Protection (FDEP) for authorization of at least one Disaster Debris Management Site (DDMS) and to annually seek preauthorization of previously approved sites. Alternatively, municipalities may jointly apply for authorization of a DDMS with a county or adjacent municipality through an approved memorandum of understanding or interlocal agreement.

Collier County subsequently coordinated with FDEP regarding implementation of the new statutory requirements. FDEP advised that the County is not required to submit a new authorization request this year and instead must provide a fully executed interlocal agreement together with the finalized list of jointly utilized debris management sites. Collier County has confirmed that all identified debris management sites have been pre-authorized by FDEP for the 2026 hurricane season.

The proposed Amendment No. 1 updates the existing interlocal agreement to satisfy the requirements of Section 403.7071, Florida Statutes, by formally identifying the pre-authorized debris management sites that may be jointly utilized by the City of Marco Island and Collier County. The agreement identifies the following sites:

• DMS Manatee Park (WACS 97990)
• School Board Site Manatee (WACS 98132)
• Resource Recovery Park (WACS 99069)
• Carnestown Transfer Station (WACS 73088)
• Collier County Landfill (WACS 73046)
• Marco Island Recycling Drop-off Center (WACS 73044)

The amendment also preserves the City's ability to seek preauthorization of alternative debris management sites from FDEP if warranted in the future.

 

Approval of Amendment No. 1 will ensure the City remains compliant with current Florida law and maintains access to a network of pre-authorized debris management sites for use following hurricanes and other declared emergencies. The amendment formalizes the City's continued participation in Collier County's regional disaster debris management program and preserves the longstanding cooperative approach to debris collection, management, and disposal.

The joint utilization of County-managed debris management sites eliminates the need for the City to independently identify, permit, and manage separate debris management sites while providing operational flexibility and enhanced emergency preparedness.


The City Attorney has reviewed the proposed amendment for legal sufficiency. The amendment is intended to satisfy the requirements of Section 403.7071, Florida Statutes, as amended by Chapter 2025-190, Laws of Florida.

 

 

FUNDING SOURCE / FISCAL IMPACT: There is no direct fiscal impact associated with approval of this amendment. The amendment preserves the City's eligibility to utilize regional debris management resources and supports compliance with state requirements for disaster debris management planning.

 

 

RECOMMENDATION:
Approve Amendment No. 1 to the Interlocal Agreement between the City of Marco Island and Collier County regarding disaster debris removal and the joint utilization of Disaster Debris Management Sites (DDMS) and authorize the City Manager to execute the amendment.
