First Amendment to the Urban County Cooperation Agreement with Collier County - Joan Taylor, City Clerk

BACKGROUND:
The City of Marco Island entered into an Urban County Cooperation agreement with Collier County on July 9, 2024 (approved April 8, 2024, City Council meeting). The agreement establishes funding opportunities for Fiscal Years 2025-2027through the County from the U.S. Department of Housing and Urban Development (HUD) programs: Community Development Block Grants (CDBG), HOME Investments Partnership Program (HOME) funds, and Emergency Solutions Grants (ESG) funding .
HUD is requiring that additional requirements are included with the City’s and County’s agreement.
Additional language in the agreement:
1. Covers CDBG, HOME, and ESG Programs.
2. Specifies the qualification period for our Urban County agreement with the County (the three fiscal years covered by the agreement).
3. States that the agreement also covers 1) the HOME program and 2) the ESG program and that Marco Island, the participating Unit of General Local Government (UGLG) may only receive HOME and ESG formula-allocated funds from the Collier County.
4. States that Collier County and the Marco Island will comply with all federal laws and regulations specified in HUD’s Urban County Notice.
5. States that the agreement remains in effect until all funds (CDBG, HOME, ESG, and any program income) are expended and all activities are completed.
6. Includes a provision that Marco Island, the participating UGLG may not sell, trade, or transfer any HUD funds provided by Collier County (our Urban County).
Attached is the First Amendment. It has been reviewed by the City Attorney.
