BACKGROUND

 

DESCRIPTION:

 

The applicant, the City of Marco Island, is requesting approval to amend several sections of the City Code, including provisions within the Land Development Code, to allow required legal notices and advertisements to be published on the Collier County publicly accessible website. Previously, all legal notices were required to be published in a newspaper of general circulation.

 

The transition from newspaper publication to website posting was authorized by House Bill 7049, which amended Chapter 50, Section 50.0311, Florida Statutes, effective January 1, 2023. The City elected to delay implementation to observe and evaluate the experiences of other municipalities, assess potential impacts on staff resources, and develop a transition plan to ensure an efficient and successful implementation.

 

The City currently budgets approximately $42,000 annually for legal noticing. Collier County has confirmed that there will be no cost to the City of Marco Island to post legal notices on the County’s website.

 

The City has provided a staff memorandum detailing the noticing requirements and associated procedures.

 

Transitioning legal noticing requirements from newspaper publication to the Collier County website will not only result in cost savings but will also enhance transparency and accessibility for residents. This approach recognizes changing media consumption habits and allows notices to remain publicly available for extended periods, rather than being limited to a single day of publication in a newspaper.

STAFF RECOMMENDATION

 

Staff recommends that the Planning Board forward a recommendation for approval of the proposed ordinance to the City Council, which contains the proposed amendments outlined in the staff report, to replace requirements of legal noticing from appearing in the newspapers to the Collier County Website.
