RESOLUTION - Boat Dock Extension (BD-25-000017) request to Modify the 2008 Boat Dock Approval to Allow for the Addition of Boatlifts to Accommodate Vessels and Personal Watercrafts for the South Seas Club Condominium located at 591 Seaview Court, Marco Island, FL 34145 - Joshua G. BACKGROUND:

PROJECT DESCRIPTION:

The existing docking facility at the subject location was granted a boat dock extension by the City Council in 2008 pursuant to City Resolution 08-05. The condominium’s shoreline is approximately 2,710 linear feet and approximately 28,984 square feet of over-water fixed and floating dock facilities. Among the conditions of approval included in Resolution 08-05 were the prohibition of jet skis and jet ski mooring. Boat lifts were also prohibited anywhere other than the waterfront along the South Seas Club tennis court property. As indicated in the application request, the request is to modify the 2008 approval to allow for the installation of boat lifts within each of the 132 existing boat slips and allow for jet skis and jet ski moorings.

Attached are the application, cover letter, plans, history on the prior approvals, and submerged survey information.  Please note, the Florida Department of Environmental Protection has provided their approval for the proposed lift additions.

RECOMMENDATION:

STAFF RECOMMENDATION AND FINDINGS:

As of the date of this report, Staff have received numerous public comments, approximately two dozen, regarding the proposal.

Overall, Staff finds that the application meets 7 of 10 criteria contained in Section 54-115(f) of the City’s Code of Ordinances, as stated herein. The three criteria that the application does not meet are criteria 3, 6, and criteria 8 due to the fact that there are no special conditions, and the height of the boat lifts may impact views from adjacent properties

Staff recommends the Planning Board forward a recommendation of denial of the requested boat docking facility to the City Council with the following findings:

Findings:

The proposed addition of boat lifts within existing slips is not necessitated by any special conditions related to the waterway or property.

The proposal is to install boat lifts into the existing boat slips. The applicant states that no views will be impacted by the surrounding property owners; however, Staff is concerned that the additional height of a moored vessel on a boat lift may obstruct the views of Clam Bay for those condominium residents living within the lower levels of the adjacent buildings.

The location of the existing dock facility and proposed lifts do not appear to infringe upon the use of neighboring properties on a functional level; however, the increased height of the proposed lifts may pose an infringement to the overall use and enjoyment of adjacent units on lower floors due to the obstruction of views to Clam Bay.

POTENTIAL MOTION:

Move to approve Resolution 25-XX with the listed findings.
