DESCRIPTION:
This ordinance amends Chapter 22, Article II of the City of Marco Island Code of Ordinances by creating Section 22-39, "Fees; Payment Deadline; Enforcement." The amendment establishes a consistent process for the assessment, payment, and enforcement of Fire Rescue Department fees associated with permits, inspections, plan reviews, re-inspections, nuisance or malfunctioning fire alarms, and other services authorized under the Fire Prevention and Protection Code.
Currently, Chapter 22 authorizes the collection of various fire-related fees but does not establish a payment deadline or provide an enforcement mechanism when fees remain unpaid. This ordinance addresses that gap by requiring payment within forty-five (45) days of notice from the Fire Rescue Department and providing that failure to pay constitutes a violation of the City Code subject to enforcement through the City's Code Enforcement procedures pursuant to Chapter 14, Section 162.09, Florida Statutes, and Section 633.214, Florida Statutes.
The ordinance also clarifies that applicable fees will continue to be established and amended by resolution of the City Council, allowing the fee schedule to be updated without further amendments to the Code.
Approval of this ordinance will strengthen the City's ability to recover the costs associated with providing fire prevention and protection services while establishing a clear and consistent process for the timely payment and enforcement of Fire Rescue Department fees.

PUBLIC NOTICE REQUIREMENTS: Ordinance read by title on at least 2 separate days and shall be noticed in a newspaper of general circulation at least 10 days prior to the second reading. A Business Impact Statement is not required for items addressing the Florida Fire Prevention Code (Sec. 633.202, F.S.).
