PROJECT DESCRIPTION:
Kevin M. Dowty, P.E., with Hole Montes, a Bowman Company, has submitted for approval of an SDP for 3200 San Marco Rd. to construct a 45-unit condominium hotel, associated salon, spa, restaurant and a 45-slip marina. The application, plans and associated documents are attached to this report.

Applicant has paid $7,006.00 in applicable fees.

Staff recomends the Planning Board approve petition SDP-24-000082 with the following conditions:
Conditions:
1. Pursuant to the City Council’s approval of APCC-22-00293 on February 21, 2023, any use of the property may not include residential use.
2. The condominium documentation shall be reviewed and approved by City Staff and a copy of the recorded document be provide to City Staff before a building permit is issued.
3. Approvals from the Florida DEP and U.S. Army Corps of Engineers may be required prior to the City issuing any permits. The Owner will need to verify any permit requirements with the DEP and USACOE.
4. The Owner must obtain annual grease trap permit. Please contact khayman@cityofmarcoisland.com
5. All sewer fees must be paid. Please contact khayman@cityofmarcoisland.com
6. The Owner will need to record a unity of title in the Collier County Public Records prior to the issuance of any building permits. The Unity of Title shall join the two parcels for development purposes, and must be reviewed and approved by the City Attorney prior to recording along with an opinion of title provided by a Florida licensed attorney.
7. A separate Right-Of-Way permit is required for any work within the right-of-way.
8. The South Florida Water Management District (SFWMD) Environmental Resource Permit (ERP) shall be submitted prior to the building permit application.
9. If SFWMD determines that an ERP is not required, the City shall review the proposed stormwater management system as part of the building permit review process. Based on that review, the City may require revisions to the site plans or stormwater management system, as necessary, to ensure compliance with the City's applicable stormwater quantity and water quality requirements.
10. Fire-line sizing for the marina shall be calculated by a Florida-certified Fire Protection System Contractor I, II, or V.
11. All fire-protection appurtenances including fire department connections (FDCs), fire hydrants, backflow preventers, and post-indicator valves (PIVs), shall maintain a minimum 3-foot clear area in all directions, free of landscaping or other obstructions.
12. Compact parking spaces must have a sign installed every 3rd space, with the word “compact” painted on every space and double white lines.
13. The site plan must comply with all aspects of the Chapter 30, Land Development Code, unless otherwise approved by a variance.
Buildng Code Issues:
1. Please indicate the locations and calculations of the required hydrostatic flood vents.
2. Require, for all new construction and substantial improvements, that fully enclosed areas below the lowest floor that are usable solely for parking of vehicles, building access or storage in an area other than a basement and which are subject to flooding shall be designed to automatically equalize hydrostatic flood forces on exterior walls by allowing for the entry and exit of floodwaters. Designs for meeting this requirement must either be certified by a registered professional engineer or architect or meet or exceed the following minimum criteria: A minimum of two openings having a total net area of not less than one square inch for every square foot of enclosed area subject to flooding shall be provided. The bottom of all openings shall be no higher than one foot above grade. Openings may be equipped with screens, louvers, valves, or other coverings or devices provided that they permit the automatic entry and exit of floodwaters.
3. Will there be any FHA compliant units being provided. FBC sect 455, FBC-ACC sect 224, and FBC-ACC sect 806? Response is required.
4. How does the proposed pool have ADA access to the pool deck, and from the pool deck into the pool. FBC sect 454.1.2.5.6 and FBC-A sect 1009? Response is required.
5. Not all of the parking spaces shown on sheet 4 of 15 have an accessible route connected to the accessible aisle next to the ADA parking space. Florida law, s.553.5041(5)(a), F.S., requires placement of accessible routes such that persons with disabilities are not compelled to walk or wheel behind parked vehicles other than their own vehicle.
6. On sheet 4 of 15, please clarify how the proposed boat docs have an ADA accessible route from the parking spaces along the front of the building and from inside the parking garage. The 8’ walk along the side of the building is not continuous to the parking spaces along the front of the building and no crosswalks are shown connecting to it. FBC-A sect 1003.2
