BACKGROUND:
PROJECT DESCRIPTION
Mr. Patrick Vanasse of RWA, has submitted for approval of a rezoning request from Commercial Professional C-1 to Planned Unit Development (PUD) to allow for an assisted living and memory care facility (Group 623) excluding Independent Care consisting of 86 units and not to exceed 92 beds. The rezoning will also allow for in-patient hospitals (Group 622), excluding psychiatric and substance abuse hospitals. In addition, the applicant is proposing to build a new Urgent Care facility in place of the existing and remodel the other medical office facility.
Finally, the applicant is proposing to deed a portion of the required opens space to the City as a park (1.87 acres).
PLANNING BOARD
The Planning Board heard this item at the December 4, 2020 meeting. The Planning Board discussed the impacts with the neighboring residential. There was also discussion regarding the park and the building of a new Urgent Care facility. The Planning Board voted 6-0 in favor of recommending approval to the City Council with the following conditions:
1. The 1.87-acre open space be maintained by the PUD ownership. The open space is already required by the LDC.
2. Exclude Psychiatric and Substance abuse services from Nursing and Residential Care use. Include language to prohibit Independent Living as a use.
3. Revise the open space PUD plan to reflect the open space requirements of Section 30-387 instead of Section 30-1020.
CITY COUNCIL - FIRST READING
The City Council heard this item at the February 1, 2021 meeting. Council discussed the proposed park, the NCH Urgent Care and rebuild timeline, the assisted living facility and other allowed uses, and the Planned Unit Development requirements of unified control. The City Council voted 6-1 to approve and advance to the second reading on the condition that the Park & Rec Committee review the park plan with a recommendation, unified control be demonstrated by the applicant, and that NCH provide some certainty that the Urgent Care facility will be redeveloped.
PARKS AND RECREATION COMMITTEE
The Parks and Recreation Committee heard the park proposal at their February 16 meeting. The Committee recommended 7-0 that, along with what was proposed, that the park include restroom facilities and equipment for outdoor fitness. The staff approved revised park plan, plan elements, and transfer agreement is attached.
MARCO ISLAND HOSPITAL, INC.- NCH HEALTHCARE SYSTEMS, INC.
Attached is a letter dated February 9th from Paul Hiltz, Chief Executive Officer of Marco Island Hospital, Inc. and NCH Healthcare Systems, Inc. This letter states that the NCH administration will give strong support for the construction of a new urgent care facility at their September 2021 annual budget meeting. If not approved by the Board, the ALF property net proceeds will be used for upgrading their equipment and renovations of the building.
PLANNED UNIT DEVELOPMENT (PUD) REQUIRED UNIFIED CONTROL
Along with the revised ordinance, also attached is the “Declaration of Covenants” reviewed by our City’s legal team demonstrating unit control required for PUDs.
FUNDING SOURCE / FISCAL IMPACT:
Applicant has paid $10,000.00 in applicable fees.
RECOMMENDATION:
The City Council approve the rezone from C-1 to PUD with associated park agreement which includes the transfer of 1.87 acres of land to the City as a park with specified park elements/improvements including 30 years of maintenance.
This PUD will exclude Psychiatric and Substance abuse services from Nursing and Residential Care use and prohibit Independent Living as a use.
The Master PUD plan will be revised to reflect the open space requirements of Section 30-387. With a requirement of 30 percent or 3.3 acres (10 acre PUD) of open space, the park is only a part the open space requirement.
