RESOLUTION - Conditional Use Petition Request (CUP-23-000091) to allow for a Fenced in Dog Run, which is considered outdoor kenneling, located at 820 Bald Eagle Drive, Marco Island, FL 34145

BACKGROUND:
PROJECT DESCRIPTION:
The request is to allow for the continuation of the fenced area at the rear of the property as a dog run. The use is classified as outdoor kennels and requires a conditional use permit per the C-4 zone district regulations. Attached are the application, written statement and survey of the property.
FUNDING SOURCE / FISCAL IMPACT:
Applicant has paid $4,000.00 in applicable fees.
RECOMMENDATION:
STAFF RECOMMENDATION AND FINDINGS:
Staff recommends the Planning Board forward a recommendation of approval of CUP 23-000091 with the below conditions and findings:
Findings:
1. There does not appear to be an adverse effect on the public interest based upon the information provided by the applicant that the dogs are not unsupervised when in the dog run, it is not used for outdoor holding quarters, and we have not received any comment from adjacent neighbors.
2. The granting of this conditional use will be consistent with the Future Land Use Element, Objective 1.2:
The City will manage growth to enhance the community both fiscally and physically, protect property values, and encourage, where appropriate, housing, goods and services, community amenities, and local employment opportunities.
3. This is an existing structure built in 1991 and has proper ingress and egress from Bald Eagle and Herb Savage Way alley in the rear.
4. The use of the dog run does not appear to be incompatible with surrounding commercial uses. It is separated from multi-family in the rear by the alley. The dog run does not appear incompatible with the multi-family as we are not aware of complaints and as stated by the applicant it is not used for outdoor kenneling.
5. This is an existing building constructed in 1991, is not a detraction from the streetscape and compatible with surrounding structures.
Conditions of Approval:
1. The dumpster enclosure is located slightly off the property and in the City’s alley right-of-way and the encroachment must be removed.
2. Overnight kenneling in the fenced dog run is not allowed.
3. A building permit is required for the existing fence.
POTENTIAL MOTION:
Move to approve Resolution 23-XX with listed findings and conditions.
