Title
Appointment of City Council Vacancy - Joan Taylor, City Clerk
Body
BACKGROUND:
During the December 2nd City Council meeting, Councilors selected by paper ballot four finalists from a list of 24 applicants to fill the vacancy generated by Councilor Greg Folley’s resignation (made on May 16, 2024), effective November 5, 2024.
The following 4 finalists are:
• Daniel Bryant
• David Leaser
• Martin Winter
• Teri Sommerfeld
Finalists will have the opportunity to provide closing remarks and answer City Councilor questions.
Based on Article III, Section 3.05.3.b of the City Charter, Council members will motion for the appointee. A majority vote shall determine the next appointed Councilor. If there is a tie, that motion fails and another motion is made.
Prior to the motion being made, Council members may discuss and agree upon using a voting method to arrive at that nomination which shall be voted upon.
The newly appointed member will be sworn in during the January 6, 2025 City Council meeting.
***If an appointment cannot be made from the applicant pool, Council agreed during the November 18, 2024 City Council meeting, that it reserves the right to appoint through Council nominations with Council vote.
Process Overview for Selection
Section 3.05(3) of the City Charter provides the following process for filling a council vacancy: “If the remainder of the unexpired term is 28 months or less, the remaining Council members shall, within sixty (60) days following the occurrence of such vacancy, by majority vote of the Council Members, appoint a person to fill the vacancy for the remainder of the unexpired term.”
Councilor Folley’s term was set to expire in November 2026. Twenty-four (24) months of Councilor Folley’s term is left vacant based on his November 5, 2024, resignation. A replacement member shall be appointed by the City Council within sixty (60) days following the occurrence of the vacancy, which is no later than January 6, 2025.
During the November 18, 2024 and December 2, 2024 City Council meeting, Council members agreed to fill the vacancy through an application process which will include interviews by Council members with a vote for appointment.
Process details:
1. Applications accepted November 6, 2024 and extended to Friday, 5:00 pm on November 22, 2024.
2. At a Special-Called City Council meeting on December 2, 2024, Council members narrowed down applications (by paper ballot voting) to four (4) finalists. The finalists were announced by the City Clerk at the Special-Called meeting on December 2, 2024.
3. Councilors interviewed finalists during the month of December.
4. Finalists were invited to attend the January 6, 2025 regular City Council meeting for final remarks and answer questions. Council members will motion and vote on the appointee. A majority vote shall determine the next appointed Councilor. If there is a tie, voting will continue until there is a majority.
5. The newly appointed member will be sworn in during the January 6, 2025 City Council meeting.
