BACKGROUND

The Caxambas Court Bridge over Roberts Bay was originally constructed in 1973 and has provided access to residents and visitors for more than fifty years. In 2023, the Florida Department of Transportation (FDOT) completed a structural inspection and determined that the bridge is structurally deficient and in need of replacement to ensure its long-term safety, reliability, and serviceability.

 

On February 5, 2024, City Council approved Resolution 24-06, authorizing the City Manager to execute a Locally Funded Agreement with FDOT for the City's 25 percent share of the bridge replacement design costs under FDOT Financial Project No. 445460-1-32-01.

 

FDOT has since completed the design phase of the project and is currently preparing the Invitation to Bid (ITB) package for demolition and reconstruction of the bridge.

 

The engineer's estimated construction cost for demolition and reconstruction of the bridge and associated roadway and drainage improvements is $11,436,709.86.

 

The attached resolution authorizes the City Manager to execute a Locally Funded Agreement (LFA), a Three Party Escrow Agreement (TPEA), and a Transportation System Post Project Maintenance Agreement (TSPPMA) necessary to facilitate the demolition, reconstruction, and long-term maintenance responsibilities associated with the bridge replacement project.

 

Under the terms of the agreements, the City of Marco Island's financial obligation for construction of the bridge replacement project and associated roadway and drainage improvements is $3,397,181.00, representing approximately 29.7 percent of the engineer's estimated construction cost. FDOT will fund the remaining project costs of approximately $8.04 million.

 

Execution of these agreements is necessary for FDOT to proceed with advertising and awarding the construction contract.

 

While the City's current estimated obligation is $3,397,181 based upon the engineer's estimate, actual construction costs will not be known until bids are received. Under the terms of the Three Party Escrow Agreement, if construction bids exceed the engineer's estimate, then that would result in an increased local funding obligation, and the City would be required to deposit the additional funds into escrow within fourteen (14) days of FDOT's request.

Accordingly, staff is requesting $4.5 million for the project within the proposed FY2027 Public Works Capital Improvement Program (CIP) budget to provide sufficient contingency funding in the event that construction bids are higher than anticipated.

 

FUNDING SOURCE / FISCAL IMPACT: Funding for this project has been requested as part of the FY2027 Public Works Capital Improvement Program (CIP) budget. Approval of this item will commit the City to funding its currently estimated portion of the project cost in the amount of $3,397,181.00, leveraging approximately $8.04 million in state transportation funding toward replacement of this critical transportation asset.

 

Staff is requesting that the FY2027 CIP include a budget appropriation of $4.5 million for the project to account for potential increases in construction costs above the engineer's estimate and to ensure compliance with the escrow funding requirements contained within the project agreements.

 

These funds will become available following adoption of the FY2027 budget and after the start of the fiscal year on October 1, 2026.

 

RECOMMENDATION

Approve Resolution 26-32 authorizing the City Manager to execute a Locally Funded Agreement (LFA), a Three Party Escrow Agreement (TPEA), and a Transportation System Post Project Maintenance Agreement (TSPPMA) between the Florida Department of Transportation (FDOT), the City of Marco Island, and the State of Florida, Department of Financial Services for the demolition, reconstruction, and maintenance of the Caxambas Court Bridge over Roberts Bay (Bridge No. 034112), FDOT Financial Project Nos. 445460-1-52-01 and 445460-1-62-01/08, with the City of Marco Island's financial obligation of $3,397,181.
