Holden, Planning Manager, Community Affairs/Growth Management
Body
PROJECT DESCRIPTION:
Caxambas Park abuts water bodies more than 100 feet wide, allowing for a dock to protrude up to thirty (30) feet from the property line. The request is to extend the dock an additional three (3) feet for the Collier County Sheriff’s docking facility for a total protrusion of thirty-three (33) feet.
The application, plans and additional information are attached.
FUNDING SOURCE / FISCAL IMPACT: Applicant has paid $1,500.00 in applicable fees.
PUBLIC NOTICE REQUIREMENTS: 15 days prior to the City Council hearing.
NOTICE APPEARANCE DATE(S): March 24, 2025
PLANNING BOARD SUMMARY AND RECOMMENDATION:
The Planning Board held a public hearing and considered this request at their March 7, 2025 meeting. The item was presented and Planning Board discussion included unpermitted parking modifications to Caxambas Park, how Collier County needs to follow the rules and a violation notice needs to be issued to Collier County, possibly conditioning an approval, the slip is for the exclusive use of the Sherrif’s department, and safety concerns. After discussion the Planning Board voted 5-2 to forward a recommendation of approval with the below findings and condition.
Findings:
1. The dock will meet the other requirements and boat facility standards in the Land Development Code.
2. The applicant indicates there is sufficient water depth at the proposed location.
3. The applicant indicates the sovereign lands lease restricts the overall layout and that is the reason for protrusion of three (3) feet.
4. The dock and moored vessels do not protrude greater than 25 percent of the width of the platted navigable waterway and more than 50 percent of the waterway width is maintained.
5. The proposed docking facility is of the minimum dimensions necessary to adequately secure the moored vessel while providing reasonable access to the boat for routine maintenance.
6. The layout, dimensions, and location will have no impact of the view to the channel.
7. The vessel is not in excess of 50 percent of the length of the water frontage of the property. Since this is not a riparian setback variance, this criterion is not applicable.
8. The location of the existing and proposed dock facility does not appear to infringe upon the use of neighboring properties, nor any existing boat docking facilities.
9. The applicant indicates no seagrasses are located within the vicinity.
10. The proposal is subject to the Manatee protection requirements and must comply with the requirements.
Condition:
1. The approval is subject to the Manatee protection requirements. Should the proposed dock qualify for an exemption to these requirements, Staff is requesting a letter from Collier County indicating a review is not necessary. The letter shall be submitted as part of the building permit application.
POTENTIAL MOTION: Move to approve Resolution 25-23 with the listed findings and conditions.
