DESCRIPTION:
The Beach & Coastal Resources Advisory Committee was directed by the City Council to review and recommend updates to the City’s beach regulations. An initial workshop was held on November 19, 2025, where City staff presented concerns regarding unauthorized vendor structures on the beach that do not comply with existing code. In response, staff proposed establishing a permit process for temporary structures, allowing vendor kiosks to be reviewed by the Building and Zoning Departments.
The Committee discussed beach vendor operations, including the pre-setting of chairs and umbrellas, and received input from residents, vendors, and legal representatives. Additional discussions addressed the use and regulation of vehicles and trailers associated with vendor activities on the beach.
The City Council reviewed the first reading of Ordinance 26-03 during the April 20, 2026, meeting and voted 6-0 (one member absent) in favor of moving the Ordinance onto a second reading with the change underlined below:
(f) Location and placement.
1. Beach kiosks must be located entirely within the area authorized by the City’s approved Site Plan for the vendor’s operation, within the parcel boundary of the host property, and shall not be placed within dune areas, dune vegetation, or any area designated for dune protection, or seaward of the mean high-water line.
2. The placement restrictions of the Beach kiosk must be consistent with Sec. 41 (d) 1-4 and 6.
FUNDING SOURCE / FISCAL IMPACT: N / A
PUBLIC NOTICE REQUIREMENTS: Ordinance read by title on at least 2 separate days and shall be noticed in a newspaper of general circulation at least 10 days prior to the second reading. A Business Impact Statement shall be available on the City Website prior to the legal notification (posted April 22, 2026).
