DISCUSSION- Continued from the 10/4/24 Planning Board Meeting - Parking Requirements for Existing Commercial Space - Mary P. Holden, Planning Manager - Community Affairs/Growth Management

Body

BACKGROUND:

History

The Planning Board discussed the topic of eliminating parking requirements for businesses going into existing commercial spaces (bullet point summary included).  In addition, the Planning Board discussed and agreed to eliminate the need for a variance when new development (or existing if possible) provides parking more than 120% of the required parking.

The Planning Board directed Staff to keep the parking requirements when uses intensify or an existing use increases in intensity and draft something for like for like businesses.

In reviewing suggestions from the Planning Board, Staff is recommending making no changes for the reason outlined below:

•                     No staff time is saved doing “like for like” since more than a few businesses, whether new owner of a business or new business, do not have an existing commercial land use (CLU) verification, which then requires the submittal of an approved site development plan (SDP), identifying existing uses and their parking requirements, etc.

In our research, we discovered that the City of Sanibel effectively removed parking requirements.  A copy of the signed ordinance is attached to this report.

We will draft an amendment eliminating the need for a variance if parking provided is over 120% of the required parking for the March meeting.
