C-HAWQ Unsolicited 3P Proposal Submitted March 31, 2025 - Zachary W. Lombardo, Esq., Woodward, Pires & Lombardo, P.A. Attorneys-at-Law
Body
BACKGROUND:
On August 2, 2024, the law firm of Woodward, Pires & Lombardo submitted an unsolicited public-private partnership proposal (P3) to the City on behalf of Earthwerks Land Improvement and Development Corporation ("Earthwerks"). The proposal, titled the Coastal Habitat and Water Quality (C-HAWQ) Initiative, outlined a sediment dredging solution that may provide the City with both cost efficiencies and ecological enhancements.
During the City Council meeting on September 23, 2024, former Council members expressed interest in further exploring the concept and requested that Earthwerks submit a comprehensive proposal for review by both City Staff and Council.
On March 17, 2025, Earthwerks submitted a detailed proposal and subsequently provided responses to questions raised by City Staff on March 31, 2025.
Attorney Zach Lombardo, representing Earthwerks, will present the proposal to Council and respond to any related inquiries.
Given the technical complexity of the proposed initiative, Section 255.065(3) of the Florida Statutes also permits the procurement of independent technical reviews, funded by the Proposer and submitted to the Municipality. Accordingly, the City has engaged Humiston & Moore Engineers, a coastal engineering consulting firm, to provide a proposal to conduct a technical review and recommendation.
Should Council elect to proceed with the C-HAWQ initiative, a series of subsequent Council meetings will be scheduled to continue advancement though the P3 process.
